Plan To Win: Terms of Service

Effective date: 7 October 2026 · Last updated: 27 October 2026 · Version: 2026-10-27.1

1. Introduction and Definitions

1.1 Who we are. These Terms of Service (the "Terms") are an agreement between you and Zackery Frank Boyle, carrying on business as Plan To Win, of 4718 Stanley Rd SW, Calgary, Alberta T2S 2R2, Canada ("PTW", "we", "us" or "our"). "Plan To Win" is a trade name registered in Alberta, and the business is operated as a sole proprietorship.

1.2 Defined terms. In these Terms:

1.3 Products and services covered. These Terms, and the other Legal Documents, cover the whole Plan To Win family under one set of rules:

Where a document says "the Service" it means all of these unless it says otherwise.

1.4 Headings. Headings are for convenience only. "Including" means "including without limitation".

2. Agreement and Acceptance

2.1 The Legal Documents together are the whole agreement between you and us about the Service. If a Legal Document conflicts with these Terms, the more specific document controls for its subject (for example, the Privacy Policy for how we handle personal information, and the Coaching Addendum for Coaching).

2.2 You accept the Legal Documents by ticking the boxes on the "Before you start" screen and pressing "I agree, take me in", as set out in Section 3. The line under our sign-up form also tells you that by creating an Account you agree to the Terms and the Privacy Policy. If you do not agree, do not create an Account and do not use the Service.

2.3 Accepting electronically has the same effect as signing on paper.

3.1 You must accept the current Legal Documents to use the Service. Before you can use the app, we ask you to confirm three things on the "Before you start" screen:

You must tick all three boxes. We do not pre-tick them.

3.2 What we record. We record that you accepted, when, and which version of each Legal Document you accepted. See the Privacy Policy for what else we store with that record.

3.3 If we change the Legal Documents. If we make a material change to any Legal Document, we will tell you in the app and by email at least 14 days before the change takes effect where we can, and we will ask you to accept the new version on the same screen. A material change is one that affects what personal information we collect or share, who our main service providers are, how the AI Features, the Social Features or the safety notification work, our fees, our limits of liability or the release, the minimum age, the party you contract with, or the governing law. We will explain what changed in plain language. We do not treat a small correction, such as a typo or a new contact detail, as material, and we will not ask you to accept again for one.

3.4 If you do not accept. If you do not accept the current Legal Documents, including when we ask you to accept again after a material change:

3.5 Subscribers. If you have a paid Subscription and you decline a material change, we cancel your Subscription and refund you, pro rata, for the unused part of the billing period you have already paid for. You decline when you choose "I still don't agree" on the decline screen or tell us in writing. If you have not accepted within 30 days after the change takes effect, we treat that as declining, so you are not billed for a Service you cannot use. During the free Beta nothing is charged, so there is nothing to refund.

3.6 The Map of You. Before the Map of You quiz asks you anything, it shows a short "Before you start" step. You must confirm you are 18 or older and agree to the Legal Documents to start the quiz. A separate, optional box asks whether you want marketing email, and it is never required. If you later create a Plan To Win account, the app still shows its own "Before you start" screen unless a consent record for the current version already exists for that account. If you decline on the Map of You, the quiz does not start and nothing is collected.

3.7 Declining is not a penalty. Declining is a genuine option. We will not charge you any fee for it, and it does not affect your right to your data (Section 11.5).

4. Eligibility

4.1 Minimum age. You must be at least 18 years old to create an Account, use the Service, or take the Map of You quiz.

4.2 Age confirmation. You confirm you meet the minimum age. We check this using the date of birth you give us, or your confirmation on the "Before you start" step. If we learn that someone under the minimum age has an Account, we close it and delete the personal information we hold about them.

4.3 Capacity and location. You confirm you have the legal capacity to enter this agreement and that using the Service is lawful where you live. We built the Service for people in Canada and the United States. You may use it from elsewhere, but the Service is not designed for, and we make no promise that it meets the local laws of, every country.

4.4 Not for treatment. The Service is not intended for people looking for medical, psychiatric or crisis care. See Section 13.

5. Your Account and Account Security

5.1 Accurate information. Give us accurate information when you sign up and keep it up to date.

5.2 One person, one Account. Do not share your Account or sell or transfer access to it.

5.3 Sign-in. You can sign in with an email address and password, or with Google. If you use Google, Google's own terms apply to that sign-in.

5.4 Keep your login secure. Choose a strong password, keep it private, and do not use the same password on other services. You are responsible for activity on your Account, unless it happened because of our failure to use reasonable security.

5.5 Tell us fast. If you think someone has used your Account without permission, contact us at hello@plantowin.app and change your password.

5.6 Account changes we may require. We may ask you to verify your identity before we act on a sensitive request, such as deleting an Account or changing its email address.

5.7 Username. You may choose a username. It is shown to people you link with in Social Features (Section 16) and must not impersonate anyone or be offensive; we may ask you to change it.

6. The Beta and Changes to the Service

6.1 What the Beta is. Some people are invited to a free early-access Beta. Nothing is charged during the Beta, and no payment screen appears. When the Beta ends for your Account we will tell you by email, at least 14 days before, what happens next. We may give Beta testers free or discounted access afterwards (for example a "Founding Member" grant); any such offer, its length and its conditions are stated when we make it.

6.2 What to expect. The Service is still being built. It may have bugs, downtime and changes. We do not guarantee that it will always be available, accurate or free of errors, or that any feature will continue to exist. Features may change, move or be removed at any time.

6.3 Keep your own copy. Data could be lost or changed in ways we do not intend. Keep your own copy of anything that matters to you. You can download your data in Settings.

6.4 Nothing converts to a charge by surprise. When the Beta ends we will tell you by email what happens next, at least 14 days before it does. You will not be charged unless you choose a plan and enter payment details yourself.

6.5 Ending the Beta. We may end the Beta, or remove a tester, at any time.

6.6 Changes to the Service. We may add, change, suspend or discontinue features. If we remove a paid feature in a way that materially reduces what a subscriber paid for, we will tell them, and Section 10 applies.

6.7 Future features. We may add features over time, described generally and without commitment: for example, tools you create or customise yourself, optional cycle and period tracking, other sensitive logs, and wider community features. If a new feature changes what personal information we collect or how we use it, we will update the Legal Documents first and, where the law requires it or the information is sensitive, ask for your separate consent before you use that feature. Cycle and period tracking, if we add it, will be opt-in with its own consent.

7. Acceptable Use

7.1 You agree not to:

7.2 Our rights. We may remove Content, limit features, end links, or suspend an Account that breaks this Section, and Section 19 applies.

8. Subscriptions, Billing and Auto-Renewal

8.1 Plans and price. After the Beta, the Service is offered as a free level and a monthly or an annual Membership. Our current prices are shown in the app (Settings > Membership) and at plantowin.app before you buy. Prices may differ by currency (CAD and USD) and we may offer time-limited plans, such as a Founding Member annual plan, on the conditions stated when they are offered. Before you pay anything, we will show you the plan, the price, the currency, how often you are billed, and any applicable taxes such as GST, and you will not be charged until you confirm.

8.2 Payment. Payments are processed by Stripe. Card details and your billing address go to Stripe, and we never see or store your full card number. By subscribing you authorise us and Stripe to charge your payment method for each billing period until you cancel.

8.3 Automatic renewal. Your Subscription renews automatically at the end of each billing period (each month or each year, depending on your plan) at the price then in effect, and we charge your payment method, until you cancel. You can cancel at any time (Section 10). Before you buy, we will show you what applicable consumer-protection law requires for an online purchase, and after you buy we will email you a confirmation of what you agreed to.

8.4 Price changes and locked prices. We may change our prices. We will give you at least 30 days' notice by email and in the app before a change takes effect on your Subscription. If you do not want the new price, cancel before it takes effect. If a plan is sold with a "locked" price, that price stays the same for as long as that Subscription continues without a break; it ends if the Subscription is cancelled or lapses.

8.5 Failed payments. If a payment fails we retry it. Your Membership features stay on for 7 days from the first failed payment while we retry; after that your Account moves to the free level until the payment is fixed, and nothing you made is deleted. We will tell you if this happens.

8.6 Taxes. Prices exclude taxes unless we say otherwise. We collect the taxes we are required to collect.

8.7 Purchases through an app store. If we offer Subscriptions through Google Play or the Apple App Store and you subscribe that way, that store handles billing, and its terms, receipts, cancellation steps and refund rules apply to that purchase. Cancel through the store.

8.8 Usage limits. Some features, including the AI Features, have monthly limits that depend on your plan. The limits are shown in Settings > Membership. A message that trips our care screen is never blocked by a limit.

9. Free Trials

9.1 The trial. The 14-day free trial applies to new sign-ups after the Beta, when you choose a Membership. Invited Beta testers are not sent through this flow.

9.2 Payment details at the start. We collect a payment method when the trial starts. You are not charged during the trial. If no valid payment method is on file when the trial ends, the Subscription simply ends and nothing is charged.

9.3 What happens at the end. Unless you cancel before the trial ends, your paid Subscription begins automatically when the trial ends, and we charge the plan price you chose, and then renew it as set out in Section 8.3. We will remind you by email before the trial ends, and you can see your trial end date in the billing portal.

9.4 Cancelling during the trial. If you cancel before the trial ends, you will not be charged.

9.5 One trial. One free trial per person. We check this using your Account, email address, Stripe customer and payment card (we keep only one-way hashes; see the Privacy Policy), and a free pass longer than the trial counts as your free period. We may refuse a second trial if we reasonably think someone is trying to avoid paying.

9.6 Passes. We may give free passes (for example a friend pass or a challenge pass). A pass is free, needs no card, lasts for the period stated when it is given, and ends without charging you.

10. Cancellation and Refunds

10.1 Cancel any time. You can cancel your Subscription at any time in the app: Settings > Membership, which opens the billing portal. There is no cancellation fee. Cancelling stops the next renewal. You keep paid access until the end of the period you have already paid for.

10.2 Refunds. Payments are not refunded for a partial period, except:

10.3 Deleting your Account. Deleting your Account cancels any active Subscription immediately and deletes your billing customer record, apart from records Stripe must keep. The unused part of a paid period is not refunded when you delete your Account, unless you ask and we agree, or the law requires it.

10.4 How refunds are paid. We refund to the original payment method within 10 business days. Your bank may take longer to show it.

10.5 Your legal rights. Nothing in this Section limits any refund or cancellation right you have under consumer-protection law.

11. Your Content and Licence

11.1 It belongs to you. Your Content stays yours. We do not claim ownership of it.

11.2 Licence you give us. You give us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display Your Content, only so we can run and protect the Service for you. That includes sending the parts you use with the AI Features to our AI provider so it can generate your AI Output, keeping backups, showing the people you choose to link with exactly what you chose to share with them (Section 16), and, if you are a Coaching client and your coaching consent is confirmed, letting your coach see your progress. The licence ends when Your Content is deleted, except for backups and records described in the Privacy Policy.

11.3 What we will not do. We do not sell Your Content. We do not use it to show you advertising. We do not use it to train AI models. See the Privacy Policy and the AI and Coaching Disclosure.

11.4 Your responsibility. You confirm you have the right to upload what you upload, including any document you upload to build a plan, and that it does not break the law or anyone's rights. You are responsible for Your Content and for the links you attach.

11.5 Your data and your choices. You can download a complete copy of your data as a .zip of JSON and CSV files with photo links and a README (Settings > Account & Security > Download my data) and delete your Account (Settings > Delete Account), after which we email you a receipt of what was deleted and what is kept. What happens to your data is set out in the Privacy Policy.

11.6 Content we remove. We may remove Content that we reasonably believe breaks these Terms or the law. Where reasonable, we will tell you why.

12. AI-Generated Content

12.1 What the AI Features are. The AI Features use an AI model provided by a third party (currently Anthropic). Details are in the AI and Coaching Disclosure.

12.2 AI can be wrong. AI Output can be wrong, incomplete, out of date or biased. It can misunderstand you, and it can sound more certain than it should. It may be different each time you ask the same question.

12.3 Not professional advice. AI Output is general information and suggestion. It is not medical, mental-health, dietary, legal, tax, financial or other professional advice, and the AI is not a doctor, therapist, dietitian, lawyer, accountant or financial adviser.

12.4 Your final call. Everything is your final call. Check anything that matters with a qualified person before you act on it. You are responsible for how you use AI Output.

12.5 Ownership and use of AI Output. As between you and us, and to the extent the law lets us, you may use the AI Output that is generated for you for your own personal purposes. We do not promise that AI Output is unique, or that it is free of similar output given to others, or that it does not infringe anyone's rights.

12.6 Limits and safety. We may limit how much AI you can use in a month (Section 8.8). The AI Features include a safety layer, and we may notify the PTW team in the rare case described in Section 13.5 and in the AI and Coaching Disclosure.

12.7 What the coach can see. What the AI coach can see, and how you control it, is described in the AI and Coaching Disclosure.

12.8 Plans built from your documents. When you upload a plan, brief or schedule, the app reads it (sometimes with the AI) and proposes projects and tasks for you to review. The proposal can misread dates or details; check it before you accept it. You can undo an import for 7 days.

12.9 Changes the coach proposes. The coach can propose changes to your plan, such as a built day or week, a nightly plan for tomorrow, or edits to tasks and routines. A change is applied only when you approve it, unless you have switched on a setting that says otherwise, and you can undo what the coach did for 7 days. You can pause all coach changes with Let the coach make changes in Settings > Plan & coach. Review a plan before you approve it: the AI can misread a time or a detail, and you are responsible for what you accept.

12.10 Tools you build (Tool Studio). Tool Studio lets you describe a small tool and an AI writes its code from your instructions. That code is generated by AI, may contain mistakes, and runs in a sandbox inside the app with only the permissions you allow. You are responsible for the tools you build and for how you use them, and you must not use Tool Studio to build anything that breaks the law, these Terms or anyone's rights. Tools are private to your Account and cannot be shared in this version. Your tools and their data are removed when you delete your Account.

13. Health Disclaimer and No Medical Advice

13.1 Not medical care. The Service includes fitness, diet, sleep, stress and wellbeing content, tools for habits you want to quit, and the Map of You's values reading. It is for general information and planning. It is not medical advice, diagnosis or treatment, and it is not therapy or counselling.

13.2 See a professional. Talk to a doctor or other qualified health professional before you start or change any exercise, diet, fasting or weight programme, before stopping a substance you depend on, and for anything medical. Do not ignore professional advice, or delay getting it, because of something in the Service. The Health and Wellness Disclaimer has the full detail, and forms part of these Terms.

13.3 Numbers are estimates. LifeScore, XP, levels, streaks, days-clean counters and similar numbers, and your Map of You reading, are motivational tools. They are not measurements, diagnoses or predictions of your health, personality or lifespan.

13.4 Emergencies. If you are in immediate danger, or someone else is, contact your local emergency number now (911 in Canada and the US). The Service is not an emergency service.

13.5 Serious-safety notification. If our systems detect signs you may be in serious danger, we may notify the PTW team so a person can reach out. The notice contains your account and the time only, and not what you wrote. We cannot monitor in real time, we promise no response time, and we are not an emergency service. See the AI and Coaching Disclosure.

13.6 Event mode. Event mode is a set of reminders and tools for time off and planned events. It is not an emergency, medical, security or monitoring service. Plan To Win does not watch anyone, does not contact emergency services for you, and cannot promise that a message, reminder or check-in will arrive, or arrive on time (phones lose signal and run out of battery, and notifications can be delayed or blocked). Do not rely on it for your safety or anyone else's. In an emergency, call your local emergency number. Reminders about water, food, rest, charging your phone, meeting up or getting home safely are general information only, and Plan To Win gives no advice about alcohol, drugs or any other substance.

14. Assumption of Risk and Release

14.1 Risks. Exercise, changes to diet, fasting, sleep or routine, stopping a habit or substance, and the other activities the Service or a coach suggests carry risks, including muscle, joint and bone injury, cardiovascular events, dehydration, falls, overexertion, allergic reactions, harm related to eating, withdrawal effects, the worsening of a medical condition, and, in rare cases, serious injury or death.

14.2 You accept them. You take part voluntarily and you accept those risks. You are physically and mentally able to take part in what you choose, or a qualified professional has cleared you. You are responsible for your decisions.

14.3 Release. To the fullest extent permitted by law, you release and hold harmless PTW, its founder, owners, employees, contractors, coaches and service providers (the "Released Parties") from any claim, loss, injury, illness or damage (including personal injury, property damage and economic loss) arising from your use of the Service, or from following or not following any Content, plan, AI Output or advice in the Service or in Coaching.

14.4 Where the law does not allow it. This release does not apply where the law forbids it. It does not release liability for our fraud or wilful misconduct, or, where the law does not allow it to be released, our gross negligence, negligence causing death or personal injury, or breach of a right that cannot be waived under consumer-protection law. Whether a release is enforceable varies by province, country and state, and it may not be enforceable for minors. If part of it is unenforceable where you live, the rest still stands and you keep the rights the law gives you.

14.5 More detail. Section 8 of the Health and Wellness Disclaimer sets this out in full and forms part of these Terms.

15. Coaching (Optional)

15.1 Separate and optional. If you choose 1-on-1 coaching with the founder, the Coaching Addendum in the AI and Coaching Disclosure applies, in addition to these Terms. If the two conflict on Coaching, the Addendum controls for Coaching.

15.2 What Coaching is not. Coaching is coaching. It is not therapy, counselling, medical care, licensed clinical care or a guarantee of any result.

15.3 Sharing your progress. Your coach can see your progress in the app only after your coaching consent is confirmed. The app shows "Your progress is shared with your coach" when this applies. You can ask us to stop the sharing at any time.

15.4 Fees and cancellation. Coaching is an optional paid add-on, offered as one or more packages. Its fees, length, and how to cancel or ask for a refund, are stated to you when you book, and the Coaching Addendum sets out the rules that apply to all coaching.

16. Social Features

16.1 Invite-only. Social Features let you link, by an invitation code you share yourself, with a partner or friends you already know. There is no directory and no way to find or be found by strangers. At the time of this version they are in an invite-only test and may change.

16.2 What you share is your choice. Nothing is shared on a link until you choose it, link by link. What a linked person can see, and what is never shared, is set out in the Privacy Policy, Section 8. Your display name and, unless you switch it off, your profile photo are shown to linked people.

16.3 Conduct. Treat the people you link with as you would in person. Section 7 applies to anything you share. You may mute or block anyone; a block is silent. You may report a person or something they shared; we review reports and may end links, remove shared content, or suspend an Account. We are not a messaging service, we do not monitor shared text in real time, and our care screen only ever responds privately to the person who wrote something.

16.4 Challenges, plans and stakes. Challenges compare only the numbers you both agree to share for that challenge. "Stakes" in a challenge or pact are words only: no money or anything of value may be wagered through the Service, and we do not hold, pay or enforce stakes.

16.5 Ending a link. You can end a link at any time. When a link ends, items the link owned are removed; each person keeps their own final numbers from finished challenges, and the other side is shown as a former member.

16.6 Membership and links. We may require that at least one person on a link has a Membership or a pass; if so, we say so before you link.

17. Third-Party Services

17.1 Providers. The Service relies on other companies, including hosting, database, storage, payments, email, AI, sign-in, food-database, content-delivery and optional calendar services. The Privacy Policy lists them. Their terms apply to their part of the Service.

17.2 Links and integrations. The Service may link to or connect with third-party sites and services, such as findahelpline.com, Google Calendar, your phone's health app, the links you attach to your own tasks, and the outside sites some tools open for you (for example a news search, a web search, or an AI assistant, opened in your browser with only the words you typed). We do not control them, a link or integration is not an endorsement, and from the moment you leave the Service that site's terms and privacy practices apply.

17.3 Not responsible. We are not responsible for a third party's services, content, availability or practices, except as the law requires.

18. Intellectual Property

18.1 Ours. The Service, and its design, software, text, graphics, brand, name ("Plan To Win" and "PTW") and logo, belong to us or our licensors and are protected by law.

18.2 Your right to use it. While these Terms are in force we give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for your own personal, non-commercial purposes.

18.3 Restrictions. Do not copy, modify, distribute, sell, lease or reverse-engineer the Service, or remove notices from it, except as the law allows.

18.4 Feedback. If you send us feedback, ideas or bug reports, you give us a free, worldwide, perpetual right to use them to improve the Service, without owing you anything. We will not publish your name or private details with your feedback without asking.

18.5 Reporting infringement. If you believe Content in the Service infringes your rights, email hello@plantowin.app with the details.

19. Suspension and Termination

19.1 You can stop any time. Cancel a Subscription in Settings and delete your Account in Settings.

19.2 We may suspend or end your access if you break these Terms, put others at risk, misuse the AI Features or the Social Features, do not pay, or if we must for legal or security reasons, or if we discontinue the Service. Where reasonable we will tell you why, and we will let you download your data first.

19.3 Declining the Legal Documents. Section 3.4 applies if you do not accept the Legal Documents.

19.4 What happens next. When your Account ends, we handle your data as set out in the Privacy Policy. Sections that by their nature should continue to apply do so, including Sections 11.3, 14, 18, 20 to 23 and 25.

19.5 Refunds on our termination. If we end a paid Subscription other than for your breach, we will refund the unused part of the period you have paid for, pro rata.

20. Disclaimer of Warranties

20.1 To the fullest extent permitted by law, the Service is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free or secure, that AI Output or other Content is accurate, or that any result will happen. We disclaim all warranties and conditions, express or implied, including of merchantability, fitness for a particular purpose and non-infringement.

20.2 We do not promise any health, fitness, financial, relationship, work or life outcome.

20.3 Some places do not allow certain warranties or conditions to be excluded, so some of this may not apply to you, and you keep the rights the law gives you.

21. Limitation of Liability

21.1 To the fullest extent permitted by law:

21.2 What this does not limit. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for our fraud, wilful misconduct, gross negligence, or death or personal injury caused by our negligence, where the law forbids limiting it, or rights you have under consumer-protection law. Whether these limits are enforceable varies by province, country and state, and in many places consumer law overrides this Section.

22. Indemnification

22.1 To the fullest extent permitted by law, you agree to cover our reasonable losses (including reasonable legal fees) arising from a claim by someone else that comes from your breach of these Terms, Your Content, or your misuse of the Service. We will tell you promptly about the claim, and we will let you help with it.

22.2 This does not apply to claims caused by us, and it does not apply where the law does not allow it.

23. Governing Law and Disputes

23.1 Governing law. These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law rules.

23.2 Talk to us first. If you have a problem, email us at hello@plantowin.app and give us 30 days to try to sort it out before you start a formal claim.

23.3 Courts. The courts of the Province of Alberta, sitting in Calgary, have jurisdiction over disputes about these Terms and the Service, and you and we submit to them.

23.4 Consumers. If you are a consumer, you may also have the right to bring a claim in the courts where you live, and the mandatory consumer-protection laws of where you live still protect you.

24. Changes to These Terms

24.1 We may update these Terms. We will change the "Last updated" date at the top each time.

24.2 For a material change, Section 3.3 applies: we will give you notice and ask you to accept again, and Section 3.4 and Section 3.5 apply if you do not.

24.3 For a change that is not material (for example a correction or a new contact detail), the updated Terms apply from the date we post them.

25. General Provisions

25.1 Entire agreement. The Legal Documents are the whole agreement between you and us about the Service and replace anything said or agreed earlier about it.

25.2 Severability. If a part of these Terms is unenforceable, the rest still applies, and the unenforceable part is limited to the smallest extent needed.

25.3 No waiver. If we do not enforce something, that does not mean we have given it up.

25.4 Assignment. We may transfer our rights and duties under these Terms to a successor, for example in a sale, incorporation or reorganisation of the business, and we will protect your personal information as the Privacy Policy describes when we do. You may not transfer your Account or your rights under these Terms without our written consent.

25.5 Notices. We may give you notice by email, in the app, or by posting on our website. You may give us notice at the contact details in Section 26.

25.6 Events beyond our control. We are not responsible for a delay or failure caused by something outside our reasonable control, including an outage of a service provider, a network failure, or a natural event.

25.7 Language. These Terms are written in English. If we provide a translation, the English version controls, except where the law says otherwise.

25.8 Relationship. Nothing in these Terms makes us partners, agents or employer and employee.
